Role Summary
This role is based in Madrid, Spain and is a key member of the Incyte Iberia leadership team and the Global legal team.
The Director, Legal Affairs (Iberia) will primarily provide legal, compliance and privacy support to Incyte’s business activities in Spain and Portugal. The role may also support select regional or global projects form time to time, as required. This is the first in-country legal hire in Iberia, requiring an experienced legal counsel to establish and grow the legal function over time. The position will report to the Head of International Legal Affairs (based in Switzerland) and reporting line may differ depending on the experience level and profile of the successful candidate and their development needs.

Duties and Responsibilities
* Lead legal, privacy and compliance counsel for Incyte’s activities in Spain and Portugal, including legal and compliance support to marketing and sales, market access, public affairs, patient advocacy, employment, clinical trial contracting, corporate governance, compliance program implementation, etc.
* Partner with global and regional functions and the local Iberia leadership team to ensure legal, privacy and compliance risks are identified and well managed
* Provide strategic and tactical legal advice to both the haematology/oncology and IAI business units to ensure consistency between franchises as appropriate
* Work in close partnership with regional Privacy and Compliance leads to ensure the needs of the Iberian operations are well understood and that relevant aspects of global and regional plans are successfully implemented
* Provide trainings to the Iberian team in support of legal, privacy and compliance training needs and to ensure compliance with local laws and regulations
* Lead the corporate governance and legal administration of the Spanish entity to ensure legal requirements are met
* Implement and manage a compliance program that meets legal and self-regulatory requirements
* Represent Incyte at relevant trade association legal and compliance events and initiatives
* Manage the external network of legal advisors to ensure budget is effectively used
* Drafting and negotiation of all types of contracts related to the Incyte business
* Ensure risks are identified and proactively managed based on evolving regulation and enforcement
* Provision of clear, pragmatic and high quality legal, privacy and compliance advice on a wide range of business activities relating to Incyte’s pipeline and marketed products
* Legal support to company-sponsored and company-supported clinical trials and non-interventional studies in Iberia
* Lead healthcare compliance and privacy efforts within scope of geographic responsibility in line with global and regional strategy
* Lead the local compliance committee in line with global and regional policies and processes
* Identify, recommend and/or implement measures to continuously improve the legal function in Iberia and the region
* Implement the annual integrated Legal, Privacy and Compliance plan in Iberia
* Contribute positively to a strong culture of business integrity and ethics
* Occasional travel to the International HQ (Switzerland), Portugal and potentially other European countries as required
Requirements
* Law degree from a recognized Spanish university and in possession of relevant qualifications to practice law in Spain. Bar admission strongly preferred.
* Minimum of 10 years’ experience in a Spanish law firm (life sciences/healthcare) or in-house at the Spanish office of a multinational pharmaceutical company
* Excellent communication skills, with the ability to communicate complex or technical content in a convincing way to non-legal audiences
* Ethical and respectful of others
* Experience in counselling on a wide variety of matters, including interactions with healthcare professionals (advertising, education, anti-corruption, etc.) hospitals and patient associations, market access, employment, data privacy, clinical research, product launches, competition law, tendering, public entity contracting and interactions, etc.
* Solid understanding of Spanish regulatory and self-regulatory requirements applicable to the pharmaceutical industry. Knowledge of Portuguese requirements a plus.
* Experienced and adept at navigating international, multi-lingual, and cross-functional organizational matrices
* Strong knowledge of privacy regulations in EU generally and Spain specifically (Portugal a plus)
* Excellent analytical and organizational skills with a flexible mindset and can-do attitude
* Exceptional judgment and maturity; capable of properly assessing risks and proposing successful solutions, knowing when to escalate matters, and capable of taking a firm stand when necessary
* Self-aware person who can prioritize work effectively and successfully manage expectations
* Ability to identify and implement effective and innovative system- or process-level improvements to drive efficiency
* Proactive “self-starter” who is results-oriented and capable of taking the lead on projects to drive clear and timely outcomes
* Solid commercial acumen, gained through professional training or prior experience
* Strong interpersonal skills with ability to function effectively among an entrepreneurial, high-energy team to support the business in meeting its corporate objectives effectively and in a compliant manner
* Fluency in English and Spanish is required.
